Manufacture or Delivery of a Controlled Substance (2nd degree felony)
DISMISSED
Dismissed without setting the case for trial prior to a hearing on a motion to disclose the identify of a confidential informant.
At our firm, we call this type of motion a “508 motion.” Presumably, the detective did not want to disclose the identity of the said informant. Said informant was a material witness to the actual alleged drug transaction for which this client was charged. Consequently, the District Attorney’s office had to dismiss the case as a matter of law.
Assault Family Violence
DISMISSED
Dismissed without setting the case for trial, after obtaining an affidavit of non-prosecution.
Considering the scope of the admissible evidence without the cooperation of the complainant witness, coupled with admission that not everything said on the date in question may have been completely accurate due to being under the influence of alcohol, the State dismissed their case.
And this type of result is fairly typical amongst clients who hire us to represent them in this genre of case.
Indecent Assault
Reduced to a Class C ticket for Disorderly Conduct.
As opposed to the above example of the uncooperative complainant witness, in this case the complainant and her family were pushing the case fervently throughout the representation. After setting the case for trial, a failed motion to suppress, and a successful motion for discovery, additional evidence was uncovered that the complainant engaged in conduct that would shed doubt on her truthfulness, the state reduced this case to Class C Disorderly conduct.
Meaning, this client will be able to get the case expunged, and did not have to admit guilt to indecent assault.
Harassment
DISMISSED
Dismissed after setting the case for trial. Originally arrested for Stalking, the client was charged with Harassment (electronic communications) over mean twitter posts critiquing an internet celebrity. We filed a motion to quash the document charging our client with the crime on both constitutional and statutory grounds. The court granted the motion to quash. We then filed a demand for a speedy trial. The State later dismissed the case.

This case was viral on the internet due to an online feud between two YouTubers with hundreds of thousands of subscribers, making it all the more extraordinary that the State dismissed this case despite its high-profile status, even though the degree of offense was low.
